Several different considerations about this issue therefore require some thoughtful attention by all Republicans. Libertarians clearly have a general philosophical objection to the government telling private businesses the basis on which they must hire and fire their employees, so it’s easy to understand their objection to expanding such laws to include new categories.

The denial of such benefits to some helps deprive the federal government of good workers who will go instead to private industry, which is often much friendlier in its workplace policies. 25 When first introduced in the 111th session of Congress, the bill drew a number of Republican co-sponsors, including Senators Susan Collins of Maine and Gordon Smith of Oregon and Representatives Ileana Ros-Lehtinen of Florida, Chris Shays of Connecticut, and Tom Davis of Virginia. Even during that Democrat-controlled Congress, however, the bill never came up for votes in the full Senate or House.

These issues genuinely go to the heart of the principle of equal protection under the law. There is none of the moral ambiguity that may exist in the discussion about private-sector discrimination. For libertarians at least, the principle of equality under the law should be crystal clear when it comes to the government and the way it treats its employees and citizens. Amazingly, some Republicans objected to it at the time, but one of President George W. Bush’s first acts when he took office was to renew Clinton’s executive order for his own administration,22 although he came under fire from Religious Right leaders for doing so, another indicator of the huge disconnect between the American people and the self-appointed guardians of America’s morality.
